I was married to my husband over 10 yrs. we divorced and he died. I remarried and divorced 12 yrs later. I am 64 and starting to think about ss. I have only 12 yrs work experience after raising 2 families. can I collect from from my husband who died at 59 and never collected ss. sincerely, ***** *****

As a divorced spouse you can collect benefits on your ex-spouse’s record, even if the ex-spouse has remarried and even if the ex-spouse’s new spouse is collecting on the same record.

But to get this benefit, you must meet the following requirements:

  1. You were married for at least 10 straight years
  2. You are at least 62 years old
  3. Your ex-spouse is eligible for retirement benefits
  4. You are currently unmarried.

Even though you remarried, you can still receive benefits on your deceased spouse's record because unless the new marriage ended (by death, divorce, or annulment).
