Hi. My name is ***** ***** I will be happy to help you.

To receive benefits based on your ex-spouse's records you must be unmarried, at least 62, your ex is entitled to social security benefits (or currently collecting SS benefits) and benefits based on your records are less than benefits based on his records.

what happens when Im disabled now (broken back) cant work. Do I have to wait till he retires?
Expert:  emc011075 replied 1 year ago.

You are eligible for disability benefits until your full retirement age at which point your disability benefits will become socials security benefits. You are not eligible for spousal benefits until your ex is eligible (full retirement age) or apply for his benefits (at 62 or sooner if he disabled).
