Ask Social Security Questions and Get Answers ASAP
My name is***** and I will be helping you with your question today. This is for informational purposes only and does not establish an attorney client relationship.
Social Security cannot be garnished by your landlord. The only allows government entities to garnish these benefits and not your landlord. The law generally prevents creditors from garnishing private pensions and other retirement savings vehicles as well that fall under the Employee Retirement Income Security Act (ERISA). So to answer your question, no your landlord cannot garnish your benefits and if he tries to garnish your bank account, your bank will protect up to 2 months of social security benefits if those benefits are being deposited in that account.
