I was a volunteer rescue worker at the WTC on 9/11. I fought for 5 years now to receive the 9/11 volunteer fund payments. Now my lawyer says that because I am now getting those I can not receive my social security disability which I have also fought for 5 years now and am going to court for next monday. Where is it written that the 9/11 volunteer benefits are considered workman's comp benefits? I read the statute enacting the 9/11 volunteer fund and it says this: 9 § 167. Claims of volunteers. For persons who participated in World
10 Trade Center rescue, recovery and clean-up operations as volunteers, the
11 uninsured employers' fund shall be deemed to be the employer only for
12 the purposes of administering and paying claims pursuant to this arti-
13 cle. Benefits under this chapter shall be payable to such volunteers
14 only to the extent that funds are available out of funds appropriated to
15 the United States Department of Labor under Public Law 109-148 to reim-
16 burse the uninsured employer's fund for the payment of such benefits.
