I am 66 years old, retired and collecting SS retirement benefit

This answer was rated:

I am 66 years old, retired and collecting SS retirement benefit of about $2,100 monthly. My wife will retire 01/01/2014 at age 65 and 9 months. She will collect about $1,500.
Question? When I die will my wife have to continue receiving her $1,500 benefit or can she stop her payment and collect my higher $2,100 benefit?

Thank you for your question. Please permit me to assist you with your concerns.

Dimitry K., Esq. :

To answer your question directly, your spouse would have a choice of either collecting her benefit, or 50% of your benefit. She cannot collect your full benefit as the SSA specifically places a 50% cap on spouses

Dimitry K., Esq. :

She can always choose to change to your benefit, but if she is receiving more on her own, it may not make much sense to do so.

Dimitry K., Esq. :

Hope that helps. Is there anything I can clarify for you?
