Customer Question
I was married June 26,1977...
I was married June 26,1977 and divorce was finial July 1,1987 just a little over 10 years. I am 72 years of age and my ex husband is 67. Would I be able to draw on his Soc Security benefits? He made a very good income and I am currently receiving $290.00 because of something called the windfall act??? I am struggling and was told to look into this. Please advise . Thank you. Sincerely, XXXXX XXXXX Williams

Megan C :

I realize you have a question about social security. My goal is to provide you with excellent service, and help you better understand your options.

Megan C :

Hello Ramona...how are you today?

Megan C :

If you are subject to the windfall elimination provision on your own social security, you will be subject to the Government Pension Offset which will reduce anything that you would have received from your ex's record by 2/3 of your pension amount

Megan C :

So, for example if your spousal benefit was $1,200 and you received $3,000 of pension from work where you did not pay into social security, you would receive no benefits because 2/3 of your pension is greater than the potential benefit

JACUSTOMER-oyeycj9c- :

well thank you. I only want to pay for the answer to my question and do not wish to become a monthly member for your services. Have I signed up for something I'm not aware of? I understood that I would pay $5.00 now and upon receiving the answer to my question I would be billed the additional $33.00 for a total of $38.00 Please adavise

JACUSTOMER-oyeycj9c- :

I have my ex husbands soc sec number and full name etc. if this will help in a quicker response

Megan C :

We are not social security, so I cannot look up your ex husband's record

Megan C :

I can give you general information about social security

JACUSTOMER-oyeycj9c- :

Oh I am indeed on the wrong site then I thought I was chatting with someone from Social Security. How can I cancel this and not be charged? Please advise

Megan C :

Social security does not have an online option. You can contact customer service (their information is somewhere on the site) and let them know you would like a refund

JACUSTOMER-oyeycj9c- :

Thank you so much Megan. I am sorry for my miss understanding. Have a good day and God Bless you. Ramona J. Williams

Megan C :

You're welcome, and I'm sorry we couldn't give you more details.
