I was married June 26,1977...
I was married June 26,1977 and divorce was finial July 1,1987 just a little over 10 years. I am 72 years of age and my ex husband is 67. Would I be able to draw on his Soc Security benefits? He made a very good income and I am currently receiving $290.00 because of something called the windfall act??? I am struggling and was told to look into this. Please advise . Thank you. Hello Ramona...how are you today?

Megan C :

If you are subject to the windfall elimination provision on your own social security, you will be subject to the Government Pension Offset which will reduce anything that you would have received from your ex's record by 2/3 of your pension amount

Megan C :

So, for example if your spousal benefit was $1,200 and you received $3,000 of pension from work where you did not pay into social security, you would receive no benefits because 2/3 of your pension is greater than the potential benefit

Social security does not have an online option. You can contact customer service (their information is somewhere on the site) and let them know you would like a refund
