My last question wasnt completely answered. I am collecting unemployment benefits in nys and have applied for ss. disability benefits due to a medical condition. I have received 68 weeks of unemployment benefits so far. I applied for disability 3 months ago.What do i tell the unemployment dept. when they ask me if i am able to work or are looking for work? The truth. I dont want to loose my weekly benefits it is my only source of income. Let's face it, they won't last forever and may expire LONG before you win your case. You need to be prepared for that regardless. I also dont want to jeopardize my ss case or appear dishonest.I would tell them the truth, that I am willing and able to work - at a job that I can do despite my limitations (if they were to ask for that latter information). I would make sure to be looking for and applying for that FT job I think I can do, and those I think I might be able to do, and keep records of where you apply, because looking for work actively is mandatory. Being willing and able to work at a job in your area that you may be able to perform is not inconsistent with being disabled under SS. This is because being able to work PT does not disqualify one for SS and also being able to work FT at job that there are only 3 of in the region, and not being able to do other jobs, WOULD equate with disability under SS, while it would also arguably mean you are willing and able to work at a job you are qualified for and able to do. This is because to find you ABLE, SS must find that there are jobs you can do that EXIST in subtantial numbers in the regional or national economy. As of now, if you can only do jobs of which there are only a few (not a substantial number), and are willing/able to work them, you may be eligibile for UI despite later being found to be disabled under SS, being that there are no jobs in substantial numbers you can do.
