My wife bought the house just before our marriage. Here are the facts:House purchased in July 2008 and the purchase price was $196,000 on a $202,000 house value, down payment $6,000 with a loan from my wife's father and the interest rate is unknown. I estimated with 5% APR for roughly $3200 in principal payments owed to my wife as the person who purchased the house 6 months prior to marriage using a principal payment amortization schedule. Married 1-24-09. Title shows joint tenants as of 2-11-09. I started making payments on 2-1-09 Much of the down payment loan was paid back with joint money after marriage. House was refinanced in Oct 2016 and the title as of 10/26/16 listed us as joint tenants and continues to do so.The house now appraises for $324,000 and we owe $255,000, leaving $69,000 in equity.I am not sure if a reverse Moore Marsden calculation applies or if the short duration of premarital ownership coupled with the joint tenancy granted on the title gives the presumption of community property at essentially the onset of the marriage. I believe I have enough information to formulate the answer but do not know how to do so.
