The property is now going to close on July 2nd to another owner and I have requested a payoff from the escrow attorney. The borrower has agreed to and signed and notorized the amount that I have requested as payoff. The Original DOT is being recorded today. this is for my wife....her mother gifted her money for her home....she has the gift letter....somehow, her mom got the lender to add her to title and the paperwork was slipped in...my wife was unaware of the paperwork....it looks like the escrow company knew adding a gift giver to the title of the loan at closing was illegal....so they had one notary sign my wifes deed which was filed the same day...then they waited 3 days for the lender to fund the loan and recorded the mom's deed...they used a different notary for the mom to make it appear as though it happened outside of escrow...however, they included the same escrow numbers on both documents which ties them to the closing....any remedies now that she has been paying this mortgage for 6 years and her mom is trying to claim ownership?… read more
