I'm a residential home owner in Washington state. I was sent an invoice by a subcontractor for work completed that was sent and dated April 18th. We disputed the amount owed, and I haven't paid him out fully yet. On July 28th I was notified he put a Lien on my property. I thought it was invalid as it was beyond the 90 days (since the issued invoice), but he claims he came back on May 2nd (after the dated invoice and dispute began) because he "forgot" to do a few things and to fix a few things up. I wasn't home at the time but apparently he may have been let in by my general contractor who was on site. Conveniently, this moved the date of last work up to a date that seems to make the Lien valid. Could this work performed by my subcontractor (that was AFTER the full invoice was billed) be invalidated as punch-list or warranty work? Whatever this work was, I certainly did not ask for it. As the residential home owner, how would I stand if I challenge the validity of the Lien?… read more
