How much will the answer cost? HOA law firm awarded
yes, HOA law firm awarded judgement for "collection costs" based on false statements in their filing(house was abandoned,etc.,al.) house to be auctioned this week. There's a 1st mtg., so their lien is actually in 3rd position. Their own HOA docs attached to the judgement state they can do this only if there is not 1st mtg. I have a cash offer to payoff 1st. Does their lien need to be paid off by buyer to clear title I assume? I can't payoff the lien amt. which is excessive(18,700.) and they keep increasing the amt. (Made pmt. arrangements with them previously for $500./(my choice) tho i did not incur their services, but when i asked to drop it to $300 HOA CFOO demanded 4K cash in 3 weeks in order to lower the payment, i.e. refused payment of $300). The offer will cover 1st,2nd,HOA lien barely provided 1st agrees to shortsale(they previously agreed). Choices are 1)above last minute, 2)file BK last minute 3) let it goto Sheriff's sale which i was told the liens "wash off" for the new buyer, so does that mean they then continue hounding me so i have to file BK as well? … read more
