I purchased a home in Atlanta 11 mos. ago. The realtor listed the home as having 2807 sf

Lawyer's Assistant: What steps have you taken so far? Have you prepared or filed any paperwork?

I purchased a home in Atlanta 11 mos. ago. It was listed as having 2807 st. I am considering a new hvac system and the hvac company assured me my house is only 2000 plus, not 2800. To me, this house size was misrepresented

What is an MO lawyer?

This realtor purposely represented the home as being larger than it actually was.

Thank you for the additional information. I am sorry to hear of your dilemma. I realize how frustrating this is for you and I hope to provide you information which is accurate and useful, even though it may not be the news you were hoping to get. I just ask that you not shoot the messenger.

Unfortunately, in almost 35 yrs of practice, I have yet to see a broker's listing that did not contain a disclaimer for the information contained in the listing. So, it is not possible to base a fraud claim on the listing.

The misrepresentation would need to be contained in the actual sale contract to support any claims based upon the inaccuracy. Additionally, the misrepresentation would need to be intentional and knowingly made to support a fraud claim.

If the inspector included the information in his report as a confirmation, you may have a claim against the inspector for breach of contract.

So, I just do not see it likely that a viable claim exists based upon the facts presented in your question.

Are you a robot or a live person? My husband, myself and now
my husband, myself and now 4 children have rented a 2nd floor unit in Salem for almost 2 years in October and since the second month we have had a kitchen cabinet fall on to my son, heating vent fall out of ceiling onto my husbands head and drew blood, squirrels running rampid upstairs and are now chewing and scratching at the heating vents to get into our house, Refuses to test for lead and we now have a 11 month old, appliances break, sinks backed up, HVAC came out to check out a few things and we showed him that we cannot put the furnace door on because then the heat will shut off so we have to live with open flames which 1-2 days in the winter we slept with no heat and froze. Also the HVAC guy said he was going to tell the owner/Mgt Co that this needed to be fixed ASAP and we never saw him again. there were holes in the floors from the old radiators which were never covered up that my daughter caught her foot in and almost cut it because there was a metal pipe still in there, there is so much more to this and we need an attorney to help us. We did get the Board of Health involved but it seems as though the owner of our home and Atlantic Coast Homes has alot of people in his back pocket. We do everything in text and we have asked SEVERAL times to test for lead because we have an 11 month old and he refuses to do it. We do not have the $7000 to move and my husband also lost his second income because they made up get rid of his trailor. We met with attorneys last month and we were told we actually had a huge case and would get back up to 4 times the amount we paid so we were happy we found someone to help us because we literally have no where to go if we get evicted. The attorney said that he will bring all our info to his bosses and get back to us. A few hours later after we left attorneys office we got a call from our landlord which was strange because we never got a call from him so we avoided the call and the next day the attorney called me and said they were unable to work with us ;) We went from not being scared and nervous to now scared and nervous. My husband had a FANTASTIC job that paid very well and We have paid every month and yes sometimes we were late but they never said anything about it because they didnt go to the bank until the 10th so they always had it. But now that we have the Board of Health involved things are getting very uncomfortable and now they turned the first floor which has always been rented to people for 6 months or more they turned into an AirBnb. We need help the way we have had to live for a while now is uncalled for and this morning i got a nasty text from the rental agent whom i have ALWAYS had a great relationship with because we are very respectful people. But now for the first time in my life i feel helpless with 4 children. Can someone please call us and either guide us or work with us.
