I have a question about renters rights

Lawyer's Assistant: What steps have you taken so far? Have you prepared or filed any paperwork?

I would like to know what rights we have as renters. We have been at the same address for almost 20 yrs. The landlord doesn't want to fix the furnace so he decided he wants to sell the property. Which means we will have to move.

I'm sorry to hear about your situation.

Are you currently under a rental lease, or has it rolled over to a month to month without a written lease since you've been at the residence for such a lengthy time?

Your landlord is required under Nevada state law to maintain adequate working heat in your rental unit.

Failure to do so is a violation of your rights as a tenant.

If your landlord was notified of the problem with the lack of heat, and failed to remedy it, then your recourse would be to move out, and then sue in small claims court for your moving costs or other fees incurred, as this would be a breach of his duties under your lease contract.

He does have the ability to sell the home though, but the new owners should honor the existing lease contract, if there is still a written lease at this point in time.

If not, then this would have become considered as a month to month rental, in which case your landlord can sell the home by giving you adequate notice (usually 30 days notice for a month to month).

In the meantime if your landlord is failing to provide heat, then he is breaching his duties, and you can sue in small claims court to recover moving costs and/or any rent that was paid while you were without heat.
