I just purchased a new property and it lies at the low point in the neighborhood, so we are having issues with stormwatwr drainage. Their is a storm sewer basin on the neighboring property, just behind ours, and there is a natural swale leading to this basin from our property. The basin is on a drainage easement, but the easement boundary is such that to get to it via the natural swale, we must pass through a portion of the neighbors property (not part of the easement) to get to the easement. There is a portion of the easement that does abut to our property, but it is a roundabout path. We want to pipe our newly installed storm water management system to the basin inlet, but the neighbor has denied our request to do so. So I have two questions. The first is if there are options for amending a drainage easement that do not require consent from the property owner. The second is what do we need to do thin order to install piping to the basin if it is contained within the easement boundaries? … read more
