Lawyer's Assistant: Where is the property located?

Kingwood, TX. It was to restore our flooded home. I subsequently received an as-is offer for the home that my wife and I wish to pursue. On October 19th I contacted the owner of the construction company asking if we could cancel the agreement if I agreed to pay him for all goods and services to that point. He replied that he was sure we could work it out. He has performed no work thus far, but I'm certain he has order some materials. I have paid him $21,500 to date, and now he is threatening legal action. I have everything in writing (texts). The agreement I signed is not in legal language, just my agreeing to a proposal he submitted. Am I obligated to the entire agreement?

We don't want the contractor to file a lien against you property to interfere with your sale. Do you have a copy of your agreement so I can check forl legal ways to terminate the agreement?

I can email it

In the meantime you can report the contractor to the State licensing board. Since no work was performed the company should only be reimbursed for actual expenses they incurred.

This is a bad faith action on the part of the company and needs to be reported. Please give me a moment to provide the link and the email instructions.

At that time, we transferred the remaining draw amount, plus any outstanding change orders payment to the builder (it was a cash sale, not lender was used). At closing, he signed a document called the "Contractor's affidavit of completion, payment of bills and indemnity". In that document, it states that the builder "personally knows that all labor and materials used in construction of such improvements have been fully paid for, and that there are no unpaid labor or material claims against said improvements on the property where said improvements are situated." It goes on to say, "That for valuable consideration, Contractor warrants to Lender the truth of this affidavit of completion and agrees to indemnify an hold Lender harmless from all losses, damages, judgements and expenses that it may suffer, incur, or pay because any part of this affidavit of completion is not true or completely correct." The problem is... the builder has sent us new invoices since closing, and continues to send new invoices to us for work that was supposedly done on our house prior to closing.
