We have a mortgage company and there are squatter s on the property, I need to get them put as fast as possible. How long do I have to give them notice, and can I get an interim possession order and how does that work. Please tell me step by step the fastest way to get these squatters out

Hi,

I'm Lucy, and I'd be happy to answer your questions today.

If they are legitimate squatters - meaning that no one ever gave them any permission to move into the property - then they're trespassing and are not entitled to any notice. You could go to court as soon as you take title to the property and file for eviction. They could be charged with trespassing and burglary.

If they moved in with consent, either from the former owner or a former tenant, or something like that, they get one month's written notice to vacate under Tex. Prop. Code, Section 91.001. The notice should be personally served. If you don't know their names, it can be addressed to "John Does" or "Jane Does." Then, when the one month is up, if they're still there, you'll go to court and file a Complaint for eviction.

What about the interim possession order is there such a thing like that

Usually, that's for a person who is not named in the eviction suit but wants to assert rights to the premises. It's not something an owner can use to get possession before the trial.

We actually have a land contract that has defaulted to a rental, although there hasn't been an official status change. The woman we have as a landlord, claims to have left notices on our doors, but her story has changed on tht a few times. She lt a voice mail saying it was our ten day notice last Tues. I do know that it has to be in writing. We were in Michigan to see my mother this past weekend, had to spend Fri afternoon calling the Reynoldsville magistrate office, sheriff's office and state police because she was threatening to come to our home and throw out everything. I have checked with both the Reynoldsville and Brookville magistrate offices and there has not been a complaint filed. I did state during the insanity Friday that we would accept that as her ten day notice. Then Monday, we cut our trip a day short to drive back, she texts again saying she was going on to the property, were we there. She was told that we were on the road and would not be back u til late. At 10:45pm, we are about ten minutes from home and six minutes from cell dead zone, she sends us a msg telling us that we have 24 hrs to get all of our stuff gone because she is hiring people to come at 9am Wednesday, today, to get rid of everything. The state police said to call 911. But everyone says it's a civil matter and has no answers. Please help! What are our rights? … read more
