I live in Tennessee...

I live in Tennessee and need to evict a tenant on my mother's property. What steps do I take? I have written eviction letter dictating that they be out by July 31st as of now they are not staying there but claim to be moving.

Lawyer's Assistant: Because laws vary from place to place, can you tell me what state the property is in?

Lawyer's Assistant: Has any paperwork been filed?

No that's what I need to know. Where do I start?

Lawyer's Assistant: Anything else you want the lawyer to know before I connect you?

I don't think so other than the fact that the property is in a mess!

So to be clear the eviction notice stated July 31 and they left but abandoned their personal property?

No as of Monday, she said she would be moving the next day and has not shown up. She has been staying at the property most of the time.

A warrant is not the proper method; the landlord would need to file an unlawful detainer action (eviction). Here is that form:

Title 66, Chapter 28 of the Tennessee code governs this process.

Unfortunately it takes a few weeks to get a hearing, but if successful the landlord can include as damages court costs and legal fees.

We actually have a land contract that has defaulted to a rental, although there hasn't been an official status change. The woman we have as a landlord, claims to have left notices on our doors, but her story has changed on tht a few times. She lt a voice mail saying it was our ten day notice last Tues. I do know that it has to be in writing. We were in Michigan to see my mother this past weekend, had to spend Fri afternoon calling the Reynoldsville magistrate office, sheriff's office and state police because she was threatening to come to our home and throw out everything. I have checked with both the Reynoldsville and Brookville magistrate offices and there has not been a complaint filed. I did state during the insanity Friday that we would accept that as her ten day notice. Then Monday, we cut our trip a day short to drive back, she texts again saying she was going on to the property, were we there. She was told that we were on the road and would not be back u til late. At 10:45pm, we are about ten minutes from home and six minutes from cell dead zone, she sends us a msg telling us that we have 24 hrs to get all of our stuff gone because she is hiring people to come at 9am Wednesday, today, to get rid of everything. The state police said to call 911. But everyone says it's a civil matter and has no answers. Please help! What are our rights? … read more
