We live in a townhouse (pat of a condominium association) on the Windward side of Oahu in Hawaii. When we bought our townhouse in 1995, there were many trees in the front and back of our unit. Over the last 15 years or so, the association has removed FOUR trees and a large bush that directly provided shade and privacy to our home, and, after repeated complaints, a few months ago it has planted ONE small sapling, that too in the wrong place. As a result, due to the overheating due to loss of shade, our master bedroom is uninhabitable all afternoon till about

For each event, write down key details and witnesses and if there is a document that relates to it, save it and refer to it. This timeline can be very valuable in narrating your case and presenting it later in a concrete and specific way. The kind of recourse I am seeking is that they bring in and transplant two mature trees with good canopies to provite immediate relief (shade, cooling, privacy). How much would it cost to have a lawyer letter sent seeking this recourse?

A local lawyer letter should not cost more than $450 assuming a couple of hours of work. Hoa should agree to avoid court. Is that clearer?

We live in a community that has a HOA. A fellow in the community had a tree planted by the HAO in the common area next to our block wall.(5') from our property. This fellow said to the board that he wanted it there to offer shade of the west sun on his coach, which is across the street from us. As it turns out, this tree location does not offer any shade to his coach location at any time of the year. It does however pose a treat to our property. These trees (sissoo) grow quickly and can have a 50 spread. The fellow was upset that we built our house because it blocks his view. I am convinced that the true reason he wanted the tree there was to block our view of his lot. This is known as a spite fence. We had a meeting with the general manger and the "Advisory Board" and formally asked that the tree be removed to protect our property from damage, and to stop our view of the foothills from being blocked from out upstairs deck.
