I need a California HOA lawyer, california, I bought a condo
I bought a condo in San Clemente in January to use as a second home and vacation spot for me and my friends and family, filling in with paying guests between our visits. I did a lot of due diligence before buying and bought one in which the HOA and city have minimum 30-day lease requirement. None of the 4 guests I've had has stayed for the full 30 days but I have reserved the property for 30 days every time. The HOA is up in arms, claims I'm doing short term rentals and am a hotel even though it is vacant most of the time due to the 30 day restriction, and that should be better for them than people who stay the whole time! Now they are talking about imposing a 90-day minimum, which I think would be a partial taking of my property rights since it was 30 days when I bought it. They also fined me $250 which I have not paid, as I am only renting it once every 30 days. Please advise. … read more
