Application for a rent receiver must be made in
or ancillary to a civil action, either to the court before which such action is pending or, if the court is not
in session, to a judge in chambers. Notice of the hearing should be given when practical, but such
appointment may be made without notice if sufficient cause appears. Conn. Super. Ct. R. § 21-20. No bond is required as the plaintiff is a bank. Conn. Sup. Ct. R. § 21-21. In addition, a rent receiver shall provide quarterly reports to the court and reports at such other times as the court may require. Conn.
Sup. Ct. R. § 21-24.I would recommend consulting a local attorney to file a motion to show that this is unnecessary and, among other things, show that there is NOT a great likelihood of a deficiency or threatened waste being committed at the property. Consult local counsel as soon as possible to protect your rights and interests.
