Our homeowner insurance company just paid us a check to get repairs done to our roof because of Hurricane Matthew, now they are saying they want the check back because we don't have "wind" coverage. We have cashed check and signed contract to have new roof installed. What do we do??
JA: Where is the property located?
Customer: Ormond Beach, Florida
JA: Has any paperwork been filed?
Customer: What kind of paperwork? I filed a claim and they paid us a check 10 days ago. Tonight they called and said they shouldn't have paid us
JA: Anything else you want the lawyer to know before I connect you?
Customer: We have signed a contract with roofer and they have pulled a permit. We don't have the money to pay for the roof out of our pocket.

Do you have a copy of your house insurance policy? Did the insurance company refer to any particular section of your house insurance contract when it called you and told you that they did not have to pay for "wind " damage?


Finally, was the roof damaged by the rain also AND how old was the roof when the hurricane hit?
