Mortgage company is attempting to foreclose on home located in the State of Maryland. The owner/mortgagor died in 2014. I understand that the mortgage company must bring foreclosure action against the estate of mortgagor. Could you provide the federal or state case law and/or statute which dictate that the estate must be made a party to the foreclosure action.?

Why would you even think case law would be available for this and who would you expect the mortgage company to sue to foreclose if the decease is on the mortgage?
