Who gives the right to access for a driveway to be put in on a private road rightofway?
The corp of engineer have easement of RW so do the property owners. On the other side backup to a subdivision and one owner want to put a driveway to the backside of his property from private road can this be done without the approval of the owners that reside on private road

If this is a private road, the owners of the road have to give permission to infringe on the private roadway. If the person infringes onto the private road, then the owners of the private road need to file suit against the person with the driveway to obtain an injunction to prevent them from doing so. No, the person cannot get onto the road without consent of the owners.
