Good morning. There is no law regarding the time frame for the broker to pay out commissions. Since you have a broker/agent relationship, and the terms are usually governed by contact, the terms and time of payment is usually contracted. If it is not, then after a written demand for payment by you in writing, you have a right to commence an action against the broker for breach of contract. 40 days to not be paid is unusually long, and a breach of contract action may be required to force payment.
