Customer Question

Under Michigan law, what rights does a hoa member have when a board refuses to explain why it refuses to answer why it has approved insurance claims to certain individuals and not others in cases of burst pipes, and cases where the management company they hire allows an outside wall water leak to flood a unit for 4 days after being informed by a neighbor of this leak.

Write that you have is what you are already doing, which is to take the board and individual board members to court to explain their actions. The judge will have to tell you what they are required to explain under Michigan law. It is not clearly stated in Michigan state statutes that HOA board members have a duty to explain board actions to individual members. This is an article on the subject that you may find helpful. It is written by a Michigan attorney, but this should not be considered a recommendation of that attorney or his law firm, the members of which I am no personal knowledge of with.
