I am sorry for this dilemma.

The question will be assets. Do you have income from a source other than social security? OR do you have "money in the bank"?

Real Estate Lawyer: P. Simmons, Lawyer replied 2 years ago

sorry... what is A/D

And how much money is in the bank?

Ask Your Own Real Estate Law Question
Customer reply replied 2 years ago
$30K IN A BANK SAVINGS ACCOUNT.
Real Estate Lawyer: P. Simmons, Lawyer replied 2 years ago

Thanks

That is a problem.

They can seek to attach (take) the money from that account if they receive a judgment.

Should you go to court?

Frankly, that will not likely help you...that would just allow them to charge more in attorney fees

But I would try and negotiate a settlement...since they are going to be able to get an order to take money from that account to pay the judgment they will get in court

Please let me know if you have more questions. I am happy to help if I can. Otherwise, please rate the answer so I may get credit for my work.

IS IT IN MY BEST INTREST TO GO TO COURTOR NOT TO GO? THANK YOU
Real Estate Lawyer: P. Simmons, Lawyer replied 2 years ago

Best to not go (since if you go they will charge you the lawyers fees)

But best to contact and negotiate a settlement...since they are going to take the money in that bank account if you do not settle this.

Please let me know if you have more questions. I am happy to help if I can. Otherwise, please rate the answer so I may get credit for my work.

I live in a single family home. Have an 8 year old son. My HOA has a rule not allowing in ground basketball hoops in the driveway. It states they can be allowed if not visible from the front in the backyard. Well, I live on a hill in my backyard. Also, it would require me to put a concrete slab in the back. This seems excessive cost wise. I offered the HOA to modify this rule and instead asking for the hoop to be well maintained and reserve the right to fine if the hoop is rusty or falling over or whatever. The HOA argued that the 'looks' of the hoop is the reason for the rule. They didn't accept my proposal. SO there seem to be other motives for the rule. Isn't this discriminating against children and families with children? I think I made a very fair proposal to the HOA how this should be addressed... … read more
