Customer Question

A pipeline company wants a suborination agreement with my lien holder is this common?

Yes, it is common.

Here is what they are asking for - they want their lien (usually an easement right) to be declared "Senior" to your lien or mortgage, even though the lien or mortgage was first in time, and technically should be considered "senior" to the easement held by the later in time pipeline rights.

What the subordination agreement will do is take a previously Senior Lien and make it Junior to the Senior lien.

This simply changes the priority rights of the lien holders.
