While the original condo documents place no restrictions of a homeowners ability to rent out their unit, the current HOA has implemented fees that make rentals impractical. The HOA runs a limited rental pool and does not want any competition. The HOA will not allow anybody who wants to enter their rental pool, but by implementing fees, makes it effectively impossible to profitably rent your unit. The HOA has also implemented other rules and penalties which only apply to owners who rent their units outside of the HOA rental pool. Does this sound like a reasonable enough case to take legal action against HOA?
