Is it possible to revise or amend a settlement agreement

Customer Question

Is it possible to revise or amend a settlement agreement from NYC housing court? Something that was requested to be on the form is not there, and parts are illegible.

Dear Customer,

As a general matter, settlement agreements are not subject to revision or amendment. The only real exception to this rule is when the settlement is reached due to fraud, but this is very rare (the standard for this is very high).

It is presumed that the parties read and understood the final settlement agreement in the form that it was agreed upon at the time that they signed it (parties are presumed to have read and understood the contract that they signed).

The parties can renegotiate and reach a new settlement. This is one way to reach a new understanding and agreement.
