We're 55 payments past due about $132k on our mortgage.

Customer Question

We're 55 payments past due about $132k on our mortgage. We've been denied assistance by Wells Fargo about 4 or 5 times after several loan modification requests. We now have a sale date of 1/11, received a notice in mail just 2 days ago. Last denial read that it was due to us making sufficient income to make the payment. How can we negotiate a repayment plan with Wells Fargo? ? They only make us go through the whole application process again. Do we have any hope?

I am sorry to hear about your situation. My relatives were in a similar position recently. They retained an attorney who filed a lawsuit against the lender claiming they were fraudulent in that they continued to simply ask for documentation in support of a loan modification when they never really intended to do it. This may only buy you additional time to either get your finances in order or to sell the property.
