Our HOA president is embezzling association funds; he owns

Customer Question

Our HOA president is embezzling association funds; he owns 30% of the rental units in the complex, making a recall difficult. We have a recent Judgment from Florida DPR, as well as recovered legal cost expended, to determine that the president does not maintain adequate records, along with presenting hardly any invoices, as required by FL Statute 718.111. The president has fifty (50) civil judgments in NJ, and is believed to have one or more sealed felonies in NJ. A felon could not serve on a Florida HOA board.
We are about to embark on very time consuming compilation of our discovery, of vast amounts of evidence, linking the president to malfeasance of Association funds; it would save a lot time, if we could discover any NJ sealed felonies, where the president lived, until 2007.
Your help would be greatly appreciated

Rick: It sounds like you're living in a made-for-TV movie. With all the other stuff that you have against that fellow, I don't know why you would be seeking more. Are you in effect "carrying coals to Newcastle"? Sealed felonies? If such an animal actually exists, it would require a court order to unseal them. Your chances of getting that done in order to pursue a civil claim against an individual are pretty much nil. If the president is embezzling money, that is illegal, and your local County prosecuting attorney must be brought into the picture.. This website is to Provide information on legal subjects. Can we help you along those lines?
