Let me present you with some background. We are unit owners
We are unit owners within a condominium association in Pennsylvania. The condominium association is comprised of three separate (unattached) buildings. The association discovered water intrusion/structural damage in one of the buildings which contains twelve units. There are eighteen units within the two unaffected buildings, including ours. The water intrusion damage is above ground and affects common walls to several units inf the building as well as decks. The association has started repairs to the damage and has informed us that they intend to assess the cost of the damage to ALL unit owners within the association. We believe that the damage is a “limited common element” to the affected building. There are no common walls or physical structures connecting the affected building to the other buildings. Under the Uniform Condominium Act we believe this damage is a “limited common element” to the affected building and that the remaining two building units should not be assessed for the cost of the damage. … read more
