This did not answer my question. I want to know if the owner can legally sell the house after the note was due and they could not pay the note (6/1)

The fact that an owner cannot pay the note, and might even be in foreclosure does not affect his ability to sell the house. The owner holds title to the house until a Sheriff or trustee sells the property to another person. I hope this answers your question.
