Owning a mobile home in California at a 55+ park with a 45 year limit for others. Daughter/boyfriend are caregivers upon my death, daughter becomes owner thru trust. Can they remain living there if they do not meet the age limit and do not use the amenities.

Thank you for your question. Please permit me to assist you with your concerns. I am afraid that the answer would be 'no'. Since they are under the age threshold, while they can 'own' the home and potentially rent it out (if there is no rent restriction in place) to someone who is 55 or older, they themselves cannot reside there. Age restricted communities are quite stringent on such limits, and since they are no longer caregivers, they have no excuse or justification on remaining on the premises. I am sorry!
