I an a Realtor in. In Colorado and have the buyer for a home
in Colorado and have the buyer for a home under contract. In the listing it said a new gas stove with a self cleaning oven would be installed but when we saw the property yesterday a stove without the self cleaning oven had been installed. I contacted the listing broker who told me that he had specifically instructed the sellers to purchase a stove with a self cleaning oven but apparently they got a better deal on the one they purchased. Then the seller's broker told me "it is what it is" and that they had "lots of other interest" implying they would just put it back on the market -I'm assuming he meant they wouldn't respond to that if we put it in the inspection objections(?). This home also has other items to be addressed including a hail damaged roof, neighbors encroaching property line by parking non-working autos there etc. If we don't address the stove with our objections, could the buyer sue after closing or is that the final settlement? If we address it beforehand and have to compromise during inspection period it seems that it would be over-but it was promised and reaffirmed in the contract and the buyer is very disappointed. With such low inventory she may have to accept being treated like this. Any suggestions? … read more
