The way that the quitclaim deed works in the divorce situation is as follows: you would transfer title to the property to your ex via a quitclaim deed subject to the mortgage on the property with the agreement that your ex would be responsible for paying the mortgage, paying the property taxes, homeowner's insurance and all other expenses relating to the property. You are still on the hook for the mortgage if your husband does not make the payments because the mortgage company is not a party to your agreement.

As for the refinancing, you have already indicated that your ex cannot afford to refinance the property. So refinancing is out of the question.

You may negotiate with the lender for a short-sale. With the short-sale, you will be selling the house for less than it is worth with the approval of the lender. Your ex must cooperate, otherwise you would not be able to do a short-sale since your name is XXXXX XXXXX the deed to the property.
