I have a question regarding my security deposit from my landlord. I moved out of my apartment on June 2, 2018 due to two break ins to my apartment within one month. The first being April 14, 2018 where I called the police due to someone being in my home that I did not want there and asked to leave multiple times. The police came out and assisted me with this and the person ran from them. After the police left, this person returned and broke into my apartment through the patio door. The police were called again and I was able to make a report. I informed my landlord of this and she did not seem to have too much concern for me with this and tried to say that I would be responsible for the patio door which would cost $500. After I went back and forth with her about this and insisted this wasn't right because I was not responsible for this and there is a police report, she finally said that I wouldn't be responsible for this as this was a break in. I asked her if I could move then because I feared for my safety as I was sure this person was going to come back. I tried to do everything I could to not break my lease by even suggesting that I just be moved to a different unit on the property or if I could just move off of the property. She insisted that I would have to pay off the remainder of the lease and start a new one in order to do this. I told her that was ridiculous and that I might as well just keep my lease before doing that. I stayed at my mother's house for the time being because I was too afraid to go back there. I paid my rent still for that month and the month of May. I went back to my apartment occasionally to check my mail but that was it. I finally went to my apartment to go inside to get more clothes and other things I may have needed on May 31, 2018 and walked in to my bedroom window being busted out and ALL of my clothes and shoes being gone, along with other personal items. I called the police immediately and filed a report. A report was also filed with the apartment's security. I informed one of the apartment managers of what was going on and she said that it was not safe for me to stay there at this point and that she was going to do a transfer immediately the next day. I got an email the next day from the landlord stating for me to come in and discuss what happened because she had received a report from security about another break in to my apartment. I went in and talked to her and told her what I had already told the manager yesterday and she said that she didn't want me to do a transfer because at this point it would not be safe for me to be on the property at all, so the best thing is for me to just move out of the complex and just break my lease. We both agreed to this and she said that she would just hold me responsible for June's rent and then that is it because she will have the apartment rented again within 30 days so I would no longer be responsible. She said that after I moved out and they checked everything in the apartment I would receive my deposit back. I moved the very next day JUne 2, 2018 and a couple weeks later she sent my final statement via email but she had put that window on there for $300 making me owe $180 to them with no deposit back. I told her this wasn't right yet again because it was another police report and I did not do this yet again. She said in order for her to take that off I would need to send her a copy of the police report which I did the very next day. I still have not received the remainder of my deposit and she will not respond to any of my emails and when I last called about it the property manager said that the landlord was not in the office and that she just hadn't updated my final statement yet, so after that I should receive another copy and my deposit. I looked at an apartment on a Sunday, but was a little thrown back at the cleanliness of the apartment - they pretty much showed me the place right after the person moved out and did not clean (there was dirt and items on the floor). I called the realtor during the week and mentioned my concern of how clean the apartment was. She said that if I feel that it needs to be cleaned better, then she would have the person come back and do it again. The apartment is in a nice, safe location so I was just hoping it was me being nervous. On Thursday, March 30th I signed the lease but did not have a chance to meet with her on the following Saturday, April 1st to go over the apartment. Long story short, when we looked at the apartment on Saturday, I felt that it was dirty and it is more that it needs to be remodeled. I did not know what to do and the realtor can see that I was holding back tears. A few hours later, I told her that I cannot move forward with the apartment. She asked for me to put it in writing. I gave her my letter and the keys on Sunday since I was going out of town Saturday. I just found out that thankfully they were able to get someone in the apartment and are giving me back half of this month's rent but are keeping the deposit.
