No. I have a real estate contract with a buyer for a home sale. The original Texas Real Estate Commission contract did not note any exclusions in the property improvement section where all items attached to the home will be included including light fixtures, pool equipment and water softener. However, after the contract was signed the buyers agent submitted a real estate non-realty items addendum which included the water softener. We later negotiated this away with the buyers agent. Now, the buyers agent is coming back and saying it should have not been a non-realty addendum item as it was included in the property improvements on the original contract. Which takes priority, the original contract or the addendum. I thought the definition of addendum was changes that alter the terms and conditions of the original contract? … read more
