Legally does the dominate Tennent have to pay for driveway? The 3 flats tenants have 2 cars each therefore 6 cars are up and down driveway. Dominate tenant has 1 car access on driveway. 1. Could I choose what type of materials on driveway. Legally does the dominate tenement’s pay for their portion of driveway. Are the costs divided in 2.

Have only owned 3 flats since 31/8/21 I have taken photos of driveway and emailed to dominate tenant that lives out of the area.

I had the property boundary pegs flagged prior to Christmas. I contacted the dominant tenants to tell them what I was doing. They have seen the pothole driveway covered in water. They said that is what you would expect after biblical rain. With the new tenancy laws I would doubt that the 3 flats would pass the healthy homes new standards as you can’t have water lying around a property. I have brought the 3 flats up to HHS standards just waiting for the inspector to come and give written approval, I doubt if he will with the condition of driveway
