My question relates to employment law and also immigration law. Our company operates in three countries in the Pacific (Aust, NZ and New Caledonia). At the beginning of this year the head office for the Pacific in Australia decided to transfer an employee to New Zealand. In one of the latest corporate presentations by the CEO, the company organisational structure was shown to all. In that presentation slide, one department structure showed the employee who had been transferred from Australia being the Senior Planner. There was never any communication from HQ at any time that our department structure had a Senior Planner role. There also was never any communication about the existance of this role. Our direct line manager was also not aware of any such role. Understandably, a few employees, including our line manager, began asking about this role. The information given by a couple of senior executives was that this role was not officially a role withing the structure. They told the team that it had been created and included in the latest organisation structure for immigration purposes. The company had decided to help the transferred employee get a visa for entry into New Zealand. As such, they had to create a senior planner role. However, this was all only for the immigration paperwork and that the individual had no operational authority pertaining to that position on a daily basis.This particular employee had stayed the maximum time in Australia on a work visa, and being from Columbia, was not eligible for further Australian Work Visa extension. So they came with the idea of creating a false position to help him get into New Zealand and eventually obtain his NZ Residency. What I would like to know is: … read more
