Do you have an NZ Lawyer on line. This is the problem, in
Partners son died suddenly last year, no will ... Lawyers handling are at final disbursement stage as he had life ins. NZ intestate law splits assets 50/50 my partner and ex wife. Ex wife would not allow partner to be involved in ANY funeral arrangements etc and didnt even mention his name in the service. NOW she has shown up demanding how he spend his 50% of the remaining estate. ( he had life ins policy ) all dispursements have been paid and now its just the finishing off.. She wont sign to allow funds to be paid unless he bends to her wishes................ NOT the big issue.. At the sons funeral we were told that his old employer would be making a big payment to his estate..... this had slipped our minds and didnt think anything of it, NOW with the ex wife hold my partner to ransom with the funds in the estate $36k so not much, it has come to light that the Ex partner HAS RECIEVED a very substantial payment from the sons employers and has purchased a house with them. Yes she has just purchased a house and yes it was a surprise as she is was not in a financial position to do so and would also doubt would be able to borrow sufficient funds from a bank........ This payment has NOT gone through the estate and i dont think the lawyers dealing with the estate know about it.... well i would hope not...... QUESTION... should this money have been paid to the estate by the employer and QUESTION 2 can it now be recovered and correctly apportioned. We have name of employer who made the payment, should we contact the lawyer handling the estate or use another lawyer to look into.. We would like to recover this money as he has a partner who was not provided for and who we are trying to help... apart from that it is in my mind totally dishonest.........
