Hi My father has just died. I am a executor with the lawyer. The lawyer is out of town to the 16th Jan. The house lot is supposed to be sold and proceeds dispersed. I am the son a get residue post dispersal to three other at 100K$ each. I have decided to give away to my children the contents of the house. They have gone and identified what they want and we are moving stuff accordingly. Mostly tools, tv, a few cabinets and couches. So am I going to get crucified by the lawyer when he comes back to work? Also, I want my youngest son to get the deceased persons car. We agreed on a $10K price. In my opinion the dispersal of movable assets falls under the residual amount which is me. My lawyer and the estate lawyer are unavailable until the 9th and 16th. Too late for us to sit around and do nothing as we are also cleaning house and grounds etc for ultimate sale. What do you think so far? … read more

This relates to my parents' wills. Just before my father died in 2012 he asked me to organise his lawyer to visit him in hospital because he wanted to change his will. At that stage I was nominated as the POA and my brother as the executor (if both my parents had died) He wanted me to be the executor as well. He talked to a neighbour about this too. There is a record on his bank statement for 18 Jan 2012 showing a payment to the lawyer with a note of the 'lawyer's name and Will' next to it. However, after his death the lawyer had a copy of the previous doc for 2007; not updated. The lawyer was critically sick at the time and also died so the law firm was taken over. I have been assuming the position of POA for our MUm as she had dementia. SHe's just passed away and I've been notified that my brother is the executor.… read more
