I have engaged a builder to construct a residential
I have engaged a builder to construct a residential investment property. It is nearing completion and disputes are starting to arise over extras. The builder says if I don't pay his claims he will caveat my land title. Can he do this? I need to mention that there is a section in our contract that he can lodge caveat if I refuse to pay for more than 7 days. So now because of an invoice that was sent to me a few months ago at start of the project and because I wasn't agree with and I discuss that with him verbally, that the invoice he has sent me is not reasonable and over claimed, I didn't pay it at that time but agreed with him to finalise it as per contract when the final inspection passes. Sorry pushed enter. I have an issue with 2 owners who are part of a 6 owner cross lease title who will not maintain a boundary fence even though they have previously said they would. I am one of the owners at the main instigator in trying to get everyone to repair and paint the fence. I ended up taking them all to disputes tribunal 12 months ago however couldnt get an order as I didnt prepare well enough. Anyway at the hearing we all decided to paint the area of fence in front of our unit to which 4 of us have and the reminaing 2 will not do it or comunicate as to why not. Im thinking I take them back to disputes tribunal or go to arbitration. Yes it may all seam silly and trivial im the first to admit however we need to look after the property and keep it maintained for the obviouse reasons. Hope you can help … read more
