I have been given a letter by my employer regarding Annual
I have been given a letter by my employer regarding Annual Leave entitlement regarding the Covid19 wage subsidy. It outlines what my employer will reimburse me which is only part of what we were told to take. On Thursday 26th March staff were called into a meeting and then each of us had a one on one. I was informed that the GM had determined that during lockdown, I had sufficient work to carry me through 5 days. No discussions were had so not certain as to how this was the conclusion. I was then informed that I needed to put in 13 days of annual leave. I was not given time to review this and at the end of the day, I felt that my hands were tied and we were put into a situation that we had no choice. We never received anything in writing either although I did ask for it. Our contracts state 14 days notice is supposed to be given and I understand these were extenuating circumstances. I haven't signed the recent letter as I have issues with the opening line of 'in line with recent discussions ...' as no discussions have been had. I was informed today that if I didn't sign the letter that I would not be reimbursed for the 47.14hrs (what has been calculated from the 13 days) yet no where on the letter does it state that if I don't sign it I won't get it. My question is, what are my rights? I have reviewed the Wage Subsidy website and have noted that 1. Employers cannot unlawfully require named employees to use their Annual or Sick Leave, Leave without pay or other leave entitlements. 2. Being asked to use leave entitlements or any other changes to employment agreement terms cannot be done unless the changes have been discussed with you in good faith and are in writing. Can you please provide some guidance as I am in a bit of a crisis because I am being pushed into a corner and made to feel like an idiot because of how this situation has been handled.
