My wife and i have been separated for 5 years and have not

Customer Question

my wife and i have been separated for 5 years and have not split our assets at this time. The question is that 9years ago whilst still together I had a serious accident which resulted in loss of income and could not pay my terminal tax the following year, this has resulted in a debt still owing to IRD. Is my wife at this stage responsible for half of that debt .

Your wife would not be liable for any of your debts including tax although IRD may press for sale of joint assets so that your half share can be used to pay the tax
