It is contrary to the the Human Rights Act to discriminate on the basis of mental illness, but using this in court is protected by witness privilege, There is protection in giving evidence to give evidence without restriction and therefore subject to relevance this sort of question can be asked. The evidence and questions must be relevant however
She can raise this and your best response is the expert evidence in reply. It appears she has been pretty ambitious with her applications but you do seem to be on the right track. The court will only want to hear about present conditions not what happened 5 years ago
