Chris The Lawyer : If this was a right of way easement you would normally share the costs. If this is a cross lease, it may not be an easement but could be common land jointly owned. The situation would be similar then. However if the driveway just needs repair in the small part by her garage this seems excessive to replace the whole driveway. Normally you would only require maintenance when the whole driveway needed repair.
Chris The Lawyer : If therefore you feel her request is excessive, that you pay half, there is normally a procedure under a cross lease which says reasonable requests for such maintenance can be made, and the issue is whether her request is reasonable. On one hand the work is much more than is required. On the other hand you would get a new and better looking driveway which would add value to your property. So that is the test.
