Employment: We are a sports club ( Incorporated Society )
We are a sports club ( Incorporated Society ) that employee a admin/office position, 35 hours per week. Our organisation is run by an elected management committee as per our club constitution. At a meeting in 2018 the committee passed a motion that the employee would be given a pay rise equivalent to what ever the minimum wage increase was given. ( She is not a minimum wage employee). At that time the committee had no idea that there would be a Labour govenment that introduced an unprecedented large minimum wage increase in April this year, and plans on the same in April next year. ( if it was only 20 - 50 cents / hour, as it was when this 'decision' was made back in 2018, that would be OK, but given it has become a $1.20 and planned $1.10 per hour increase this is rather large. ) Nothing was recorded in her employment agreement, there is only a committee meeting minutes. Can this motion be rescinded at the next meeting, and the employee has to remain on her current hourly rate ? … read more

My question relates to employment law and also immigration law. Our company operates in three countries in the Pacific (Aust, NZ and New Caledonia). At the beginning of this year the head office for the Pacific in Australia decided to transfer an employee to New Zealand. In one of the latest corporate presentations by the CEO, the company organisational structure was shown to all. In that presentation slide, one department structure showed the employee who had been transferred from Australia being the Senior Planner. There was never any communication from HQ at any time that our department structure had a Senior Planner role. There also was never any communication about the existance of this role. Our direct line manager was also not aware of any such role. Understandably, a few employees, including our line manager, began asking about this role. The information given by a couple of senior executives was that this role was not officially a role withing the structure. They told the team that it had been created and included in the latest organisation structure for immigration purposes. The company had decided to help the transferred employee get a visa for entry into New Zealand. As such, they had to create a senior planner role. However, this was all only for the immigration paperwork and that the individual had no operational authority pertaining to that position on a daily basis.This particular employee had stayed the maximum time in Australia on a work visa, and being from Columbia, was not eligible for further Australian Work Visa extension. We have been doing this for 4 years in a row selling gourmet burgers with roving cart sales of cold drinks (Coke and water etc.) This year they have come to us with the below. Dear Billy and Stella, The Martinborough Fair Committee has given careful consideration to the renewal of the Smokey Joes stall site in 2020. The shared opinion of this Committee is that Smokey Joes Burgers has now out-grown its stall site. Our average stall is typically a small business with 1-2 static sales operators per site. In comparison, Smokey Joes has approximately 15+ volunteers, combined with a roving sales approach, that has resulted in concerned feedback from other stall holders. This Committee acknowledged that Smokey Joes has enjoyed four consecutive years at the Martinborough Fair and we trust you have benefitted from this experience.
