The police have gone to the doctor at the hospital I was treated in and requested and recieved a police report on myself but when I requested a copy they said they have to ring the privacy commision to see if they could give it to me. They said they had never come across this before. Do I have a right to this report? I was in a car that was involved in an incident with a truck, there were no witnesses apart from me and a passenger in the other vehicle. The police have charged the driver of the car I was in even though this is being disputed, they are charging the driver with making a false statement after 8 weeks. They refused to take a statement from the driver and myself untill they called me in 8 weeks later at which time I asked if they were working for the other driver or were they unbiased and just collecting information. They said they were just collecting information so I made a statement and have since found out to the contrary and am now a witness for the prosecution and the statement I made is not what I had said, in the meantime my insurance company has put my car repair on hold (the car was mine) stating the police advised them to do this but police denied it.. The car is now in pieces at the panel beaters. We told the insurance company before making the claim that there maybe a court case but were told it didnt matter what the situation so we went ahead and now the police have charged the driver with making a statement to get money advantage. The policy is not the drivers it is mine. All charges were laid at the first meeting with the police after 8weeks. The truck has also been half fixed. Can the police do this and could a lawyer get the case thrown out of court? The police did not get the witness in the trucks statement untill after the first court date. When the driver of my car finally got to give his statement he awas arrested (this was on a Saturday night) and the court date was already booked. The policeman was very interested to know as much as could about his financial situation at the time. I am very worried about all of this and the lawyer we have spoken to doesnt sound very encouraging at all, should we get another lawyers opinion, can we do this while employing this lawyer?
