If you recall we have a member and his partner up against the rest of us (4 members) calling the bc dysfunctional. In reality we all get on very well except for these two who want to run it like a boarding school. Just another body corporate!The reality is that all bills are paid before or on time and $60k was spent on painting the building a year ago with any necessary maintenance like replacement of flashing, bolts etc done at the same time.We believe that even if we didn't defend this the High Court are likely to throw it out regardless as it's a clear case of acrimony, not dysfunction.So he has filed an Originating Application in the High Court to be heard on a ten minute audio conference 2 March.Here's a few questions:He has filed it under his name and his partner as the Applicants. But the Respondents he has filed as the Body Corporate 73052. So we are not named individually. I would have thought this in error on his part as if he wins this he'll have to share all costs with other members, right?On our ‘Statement of Defense' – (And is this the right form to use?) should we sign that off as the Body Corporate or the four members, 1st Defendant, 2nd Defendant, or, 1st Respondent, 2nd Respondent, that he's accusing of dysfunction?On the Statement of Defense, the template calls us the Defendant (I guess it is Defendant if it's the body corp – Or, Defendants if we should individually name ourselves?)Or, on the Statement of Defense do we call ourselves the Respondents and not Defendants?On the same form they are Plaintiffs instead of Applicants – Which term should we use?So, a summary:Is the Statement of Defense the right form to use to defend against an Originating Application?As he's called us as the Respondent, Body Corporate 73052, do we use this throughout in our defense (as a signature) or should we use our own names?On the Statement of Defense, the terminology is Plaintiffs and Defendants.
